Terms of Use (ToU) of the Inflate Platform

Inflate is a simplified joint-stock company with a single shareholder (SASU) offering a SaaS (Software as a Service) solution for collecting, analyzing, and managing customer reviews for e-commerce businesses. By accessing or using the Inflate platform (hereinafter the “Platform”), you unreservedly agree to these Terms of Use (ToU). If you do not accept these ToU, please do not use the Platform.
1. Definitions
- User: Any individual or legal entity accessing the Platform, including e-commerce businesses subscribing to a plan.
- Services: All features offered by the Platform, including product and third-party review collection (via unique post-purchase requests), detractor management (capturing negative feedback for private resolution), AI-powered analysis of customer feedback for actionable insights, customizable widgets to display reviews on websites, and the analytics dashboard (tracking KPIs such as response rate, average rating, NPS, etc.).
- User Content: All data, reviews, feedback, and information provided by the User or collected through the Platform.
- Subscription: Paid or free contract granting access to the Services for a defined period.
2. Acceptance of the ToU
Access to and use of the Platform implies full and complete acceptance of these ToU, as well as the Privacy Policy (available on the website). Inflate reserves the right to amend these ToU at any time. Modifications will be notified by email or via the Platform, and continued use shall constitute acceptance. In case of refusal, the User may terminate their account.
3. Registration and User Accounts
- To access the Services, the User must create an account by providing accurate information (name, email, etc.). The User is responsible for maintaining the confidentiality of their login credentials.
- The User guarantees that they are of legal age, have legal capacity, and act as a professional (e-commerce business or equivalent).
- Inflate may refuse or suspend an account in case of violation of the ToU, without notice or refund.
4. Use of Services
- License of Use: Inflate grants the User a non-exclusive, non-transferable, and revocable license to use the Services for their internal needs (collecting and managing customer reviews). Any third-party commercial use is prohibited without written consent.
- Key Features:
- Sending unique review requests to collect feedback
- Private detractor management to protect online reputation
- Collection and analysis of customer feedback
- Customizable widgets to integrate reviews on websites
- User Commitments:
- Not to use the Services for illegal, fraudulent, or harmful purposes (e.g., review manipulation, spam)
- To respect the rights of third parties (including end customers providing reviews)
- Not to reverse-engineer, copy, or distribute the Services
- Service Availability: Inflate does not guarantee 100% availability of the Platform and may carry out maintenance with prior notice.
5. Intellectual Property
- All elements of the Platform (software, designs, trademarks, AI, etc.) are the exclusive property of Inflate or its licensors. The User may not reproduce them without authorization.
- User Content remains the property of the User, but the User grants Inflate a worldwide, non-exclusive license to use it as part of the Services (e.g., AI analysis, widget display).
- Inflate may use aggregated and anonymized data to improve its Services or for statistical purposes.
6. Pricing and Payments
- Services are offered under a freemium model: a limited free trial, followed by paid subscriptions (details available on the website or upon request).
- Prices are shown inclusive of VAT, in accordance with French regulations.
- In case of late payment, penalties of 1.5% per month apply, plus a fixed indemnity of €40.
- No refunds are provided for unused periods, except in the case of Inflate’s gross fault.
7. Personal Data and GDPR
- Inflate processes data in compliance with the GDPR. See the Privacy Policy for details regarding data collection (e.g., customer emails for review requests), storage, and user rights (access, rectification, deletion via support@inflate.review).
- The User is responsible for ensuring GDPR compliance for their own customers’ data (e.g., obtaining consent for review collection).
8. Liability and Warranties
- Inflate provides the Services “as is” without express warranties (e.g., accuracy of AI analyses).
- Inflate is not liable for indirect losses (such as data loss or loss of profit) nor for third-party content (such as customer reviews).
- Inflate’s liability is limited to the amount of fees paid by the User over the past 12 months.
- The User shall indemnify Inflate against any claim related to their Content or use of the Services.
9. Term and Termination
- Subscriptions are for fixed terms (monthly/annual) with automatic renewal.
- Termination: By the User via their account (30-day notice); by Inflate in case of violation (without notice).
- Upon termination, access is suspended, and data is retained for 30 days before deletion (unless legally required otherwise).
10. Force Majeure
Inflate is not liable for delays caused by events beyond its control (such as internet outages or natural disasters).
11. Governing Law and Disputes
These ToU are governed by French law. Any dispute shall be submitted to the competent courts of Nanterre. In the event of a dispute with a consumer, the provisions of the French Consumer Code shall apply.
12. Miscellaneous
- If any provision is found to be invalid, the remaining provisions shall remain in full force and effect.
- These ToU constitute the entire agreement between the parties.
